The Supreme Niger Delta Youths Council Worldwide, SNDYCW, in a public letter to President Buhari, copied respectively to the President of the Senate and the Speaker, House of Representatives, alleged that the Ondo, Edo and Imo States have been cheated contrary to the NDDC Act.
''It is our humble submission/prayer Mr. President, that in the re-composition of the next- Board of the NDDC, the Executive position of the Managing Director, CEO and the 2 Executive Director positions should constitutionally and in compliance to the NDDC Act 2000, go to the next set of States in the order of quantum of production, that Ondo State which is number five (5), Edo State which is 6th and Imo state which is 7th in the production table'', the SNDYCW stated in the letter signed by Prince Michael Newgent Ekamon and Comrade Sam Udoh, its President and Secretary-General respectively.

BREACH OF DUE PROCESS AND NIGER DELTA DEVELOPMENT COMMISSION (NDDC) (ESTABLISHMENT) ACT 2000 ACT NO 6 LAWS OF THE FEDERATION OF NIGERIA

May we start this letter by felicitating with Your Excellency on your most recent victory at the Presidential Elections Tribunal, We thank the Almighty God for granting you good health and pray that He will continuously bless you with health of mind and body which will enable you continue to deliver democracy dividend to the teaming populace as the umbrella Youth body of the 186 Local Government Areas that constitute the Nine Oil Producing States and Regional Coordinator of Presidential Support Committee (PSC-2019), it behooves us as the conscience of the good people of Niger Delta and Nation at large to bring your attention Mr. President, the issue of breach of due process and injustice that has characterized the composition of the Board of the Niger Delta Development Commission (NDDC) especially as it affect the office of the Managing Director/ CEO and the Executive Directors which over the years revolving within Akwa Ibom, Bayelsa, Delta and River State respectively since the creation of NDDC in the year 2000.
It is instructive to note Mr. President, that the NDDC Act, 2000 clearly stipulates the manner in which the offices of Chairman, the Managing Director/ CEO and two of the Executive Directors should be shared among member states of the NDDC using the rotational principles.
In section 2 (1), the Act stipulates that; “the Board shall consist of a Chairman; one person who shall be an indigene of oil producing area to represent each of the member states stated therein; the Managing Director; and two Executive Directors,” Section 4 of the Act states that the office of the CHAIRMAN SHALL ROTATE among the member states of the NDDC in ALPHABETICAL ORDER starting with ABIA State and end with Rivers State. Section 12 (1) also provides that, “there shall be for the Commission (NDDC), a Managing Director and two Executive Directors who shall be indigene of oil producing areas starting with the member states of the NDDC with the highest production quantum and shall rotate amongst member states in order of production quantum and shall have such qualification and experience as are appropriate for a person required to perform the functions of those offices under the Act”.
PRODUCTION QUOTA
For the purposes of the production quota of NDDC member states, we shall rely totally on the REVENUE, Mobilization, Allocation and Fiscal Commission (RMFAC) report which is issued from year to year.
The latest RMFAC report ranks the states in the order of production quantum;
- Akwa Ibom
- Delta
- Rivers
- Bayelsa
- Ondo
- Edo
- Imo
- Abia
- Cross River
Since the Allocation of position is bases on the quantum of production and flowing from section 12 of the NDDC Act-2000, we shall now go into the Historical perspective of position sharing since first BOARD was inaugurated in the year 2001.
ALLOCATION OF KEY BOARD AND MANAGEMENT POSITION IN THE NIGER DELTA DEVELOPMENT COMMISSION (NDDC) FROM 2001-2019
Your Excellency, section 2 of the NDDC Act created a Board for the commission and section 4 of the Act prescribes that the office of the Chairman shall rotate amongst the member state of NDDC in ALPHABETICAL order starting with ABIA State and concludes with RIVER State.
Pursuant to that provision, the following states in ALPHABETICAL order have each produced the CHAIRMAN of the BOARD as follows÷

Your Excellency Sir, whilst we congratulate our Big Sister States of Akwa Ibom, Delta, Rivers, and Bayelsa state that have occupied respectively the position of the Managing Director/CEO and Executive Directors of the NDDC, we make bold to say that in the establishment of the Niger Delta Development Commission NDDC Act 2000 and with specific reference to section 12 of the Act, these positions were not meant to be humiliation of rotating Chairs amongst the
aforementioned States of Delta, Bayelsa, Rivers and Akwa Ibom. The other sorrowful remaining States of Edo, Ondo, Abia and Cross River State are also entitled to occupy these positions.
Suffice to mention that there has also been interim Managing Directors from 2019: Late Elder P.Z Aginigham (Acting MD/CE. 17th April to 5th August, 2009, Delta state). Mrs. Ibim seminatari ( Sole Administrator, River State) and of most recently, an interim MD/CEO, Professor Nelson Brambaifa from Bayelsa with the Executive Directors from Delta and River state.
Sir, from the foregoing, it would be clearly observed that each of these “4” state had used each of these Management positions minimum of 2 time among themselves.
It is our humble submission / prayer Mr. President, that in the re-composition of the next- Board of the NDDC, the Executive position of the Managing Director, CEO and the 2 Executive Director positions should constitutionally and in compliance to the NDDC Act 2000, go to the next set of States in the order of quantum of production, that Ondo State which is number five (5), Edo State which is 6th and Imo state which is 7th in the production table.
By invocation of section 2, 4 & 12 (1) of the NDDC Act 2000, the offices of the CHAIRMAN, MANAGING DIRECTOR/CEO and the two EXECUTIVE DIRECTIORS positions should go to these States as substantiated in the table under.
