A former gubernatorial aspirant of the All Progressives Congress, APC, in Abia state, Dan Eke  on Tuesday asked a Federal High Court, Umuahia to annul the party’s governorship primary election which produced Ikechi Emenike as winner


Dailyledger.com.ng reports that the matter, which came up for hearing on Tuesday at Court 1, was adjourned to Oct. 5.


The Presiding Judge, Justice Evelyn Anyadike, adjourned the case, with Suit No. FHC/CS/96/2022, after Mr Obinna Nkume, the Counsel for the plaintiff, complained that he received processes from Counsels for the defendants on Thursday.


Nkume therefore pleaded with the court to allow him more time to enable him to complete filing his responses.


The judge obliged him and adjourned the suit to Wednesday, Oct. 5 to enable him to serve all the parties.


Joined as defendants in the suit were APC, INEC and two  chieftains of the party in the state,  Ikechi Emenike and  Uche Ogah.


Dailyledger.com.ng  reports that while INEC accepted and published Emenike’s name as the party’s gubernatorial candidate as submitted by the party, Ogah insists that he was the rightful winner of the primary election.


Speaking with newsmen after the court proceeding, Nkume, said that the modes of primaries adopted by Emenike and Ogah in the May 26 parallel primaries were flawed and violated the APC Constitution.


He said that neither Emenike nor Ogah emerged through the legitimate process stipulated in the party’s guidelines for the primary election.


He alleged that Emenike’s camp held an indirect primary, contrary to the direct mode of primary stipulated in the guidelines.


He further alleged that Ogah’s camp, on the other hand, conducted a direct mode of primary which, allegedly, was neither supervised by APC’s national election committee nor INEC.


He described the entire exercise as a “charade” and should be invalidated by the court.


Also, the plaintiff said that it was disturbing for the party to collect N50 million nomination fee from people and not conduct a transparent, fair and credible primary for a popular candidate to emerge.


He said that he already expended about N500 million during his consultations in preparation for the primary.


“This impunity by the party must end. There must be a price for the injustice.


“I do not mind whether the party would have no candidate for the election or not,” Eke said.
