The Nigerian Government on Wednesday lost its bid to transfer the suit of the extraordinary rendition of Nnamdi Kanu, leader of the Indigenous People of Biafra, IPOB, from Umuahia to Abuja.
The Federal High Court in Umuahia, Abia State, insisted that it has the jurisdiction to hear and determine the suit.
This was disclosed by Kanu’s Special Counsel, Aloy Ejimakor, in a tweet stressing that the matter was still ongoing.
He wrote: “Breaking: Federal High Court, Umuahia denies the Federal Government’s application to transfer the ‘extraordinary rendition’ suit to Abuja, and rules that Umuahia has the jurisdiction to hear and determine the suit”. Reading of the rest of the judgment continues.”
The Special Counsel was challenging Kanu’s abduction and extraordinary rendition from Kenya.
He is, among other things, praying the court to order his return to Kenya where he was abducted or United Kingdom, his country of abode.

Court Orders FG To Pay Kanu N500 Million For Extraordinary Rendition Of From Kenya
A Federal High Court sitting in Umuahia on Wednesday ordered the federal government to pay the leader of the Indigenous Peoples of Biafra (IPOB), Mazi Nnamdi Kanu, the sum of N500m as compensation for the Extraordinary Rendition of the claimant from Kenya to Nigeria in June last year.
The court presided over by Justice Evelyn Anyadike in her judgment that lasted over one hour agreed with the submission of Kanu’s lawyer, Aloy Ejimakor that Kanu’s Extraordinary Rendition from Kenya is condemnable and therefore runs foul of Kenya’s laws and as well as violates his fundamental human rights.
She therefore ordered the federal government to maintain the status quo before his Extraordinary Rendition from Kenya.
The judge maintained that the federal government violated the laws of Kenya, Nigeria and the United Nations which Nigeria is a signatory to by its action of Extraordinary Rendition of Nnamdi Kanu.
Addressing journalists in Umuahia after the court session, Barr Aloy Ejimakor, said that they came to the court to seek justice for the Injustice done to their client, Nnamdi Kanu by the federal government and expressed joy that his client has “finally gotten justice before the Honourable court”.
According to him, the suit is of a special class, whose primarily aimed is to redress the infamous and unlawful expulsion or Extraordinary Rendition of Kanu, “which is a clear violation of his fundamental rights under article 12(4) of the African Rights as well as chapter IV of the Nigerian Constitution.
“The suit is Sui generis(of a special class) and it is primarily aimed at redressing the infamous unlawful expulsion or Extraordinary Rendition of Nnamdi Kanu which is a clear violation of his fundamental rights under article 12 (4) of the African charter on Human and People’s Rights as well as chapter IV of the Nigerian Constitution”.

Kanu’s counsel further argued that what the federal government did was a case of kidnapping, adding that since Nnamdi Kanu cannot prosecute the federal government on criminal offence, he therefore resorted to civil matter to seek for redress of the violation of his fundamental human rights.
Ejimakor contended that the judgment has proved that Nmandi Kanu is not a terrorist and that IPOB is not a terrorist organization “as no terrorist organization has any lawyer defending it anywhere in the world”.
The legal practitioner therefore called on the federal government to do what is right by obeying the orders of court and restore the rights of Nnamdi Kanu without further delays, stressing that IPOB is not a terrorist organization, but a separatist group seeking for referendum through peaceful means and not through war.

Ejimakor stated that the court has proved that it is the last hope of the common man and is ever ready to checkmate some executive recklessness any time it occurs.
